This decision identifies Belgacom Mobile, Mobistar and Base as operators with significant market power on the wholesale markets for mobile call termination and imposes on them a series of obligations to fulfil.
Several appeals were lodged against the decision and, on 24 September 2014, the Brussels Court of Appeal annulled it because the media regulators had not been consulted. However, in its judgement, the Court specifies that the effects of this decision are temporarily maintained until 30 June 2015.
Following this judgement, on 6 May 2015, BIPT adopted a renewal decision rectifying the annulled decision.
