This decision concerns the tariff aspects of Belgacom’s BROTSoLL reference offer.
On 14 November 2008, Belgacom lodged an appeal against this decision, asking, on one hand, its annulment and, on the other hand, the postponement of its entry into force, pending the outcome of the appeal lodged by the operator against the market analysis of 17 January 2007.
In an interlocutory judgement of 23 September 2008, the Brussels Court of Appeal rejected the postponement request made by Belgacom. The annulment request was joined to the main appeal lodged against the market analysis of 17 January 2007. This analysis was annulled by the Court of Appeal on 15 October 2009 and then restored on 14 October 2010 by the renewal decision adopted by BIPT.
