This decision is about the BRUO monthly fee. Following an appeal lodged by Belgacom, an interlocutory judgement about it was given by the Court of Appeal on 7 April 2009.

This decision complements the decision of 11 August 2006 and identifies a series of additional operators having significant market power on the wholesale market for call termination on a fixed public telephone network. Belgacom lodged an appeal against it and an interlocutory judgement was given by the Court of Appeal on 15 February 2008.

This decision defines a national leased lines market based on SDH and WDM technologies, regardless of the speed. It concludes that Belgacom (now: Proximus) has significant power in this market and, as a consequence, imposes a series of remedies on the operator.
