This opinion has been issued by the BIPT Council on its own initiative, pursuant to Article 14, paragraph 1, 1°, of the Act of 17 January 2003 on the status of the regulator of the Belgian postal and telecommunications sectors.
The BIPT outlines the state of implementation of the obligations introduced into the Postal Act by the Act of 17 December 2023 pertaining to various provisions with a view to improving the working conditions of postal parcel deliverers and points to important implementation problems, significant administrative burdens and limited usefulness of available data for effective enforcement.
The BIPT stresses that labour and social law matters do not belong, in principle, in the Postal Act, but rather in autonomous legislation or within existing social regulations.
Subsidiarily, the BIPT makes targeted simplification proposals to reduce burdens and increase the effectiveness of the objectives.
