This public consultation concerns a draft bill and a draft Royal Decree which together will reform the legal framework for the sharing of rights to use radio spectrum at the initiative of operators.
The draft bill amends Article 19/1, § 2, of the Act of 13 June 2005 on electronic communications to:
- replace the words “gedeeld gebruik” with the word “delen” in the Dutch version of the text;
- introduce a specific prior control mechanism whereby the BIPT, according to the conditions to be set by the King, will have to check that any proposed sharing of rights to use radio spectrum will not give rise to harmful interference, harm competition or breach any conditions attached to the rights of use.
The draft Royal Decree implements the delegation of power provided for in the draft bill to define the practical details of the prior control of spectrum sharing.
